Your use of this site or purchase from Offshore Snow Shapes LLC indicates your acceptance of these terms and conditions. Offshore Snow Shapes LLC reserves the right to make changes to this web site and these terms and conditions at any time without any prior notice.

Offshore Snow Shapes LLC is the service provider; it is also referred to as “Offshore Snow Shapes”, “us” and “we”. Customer is the person or organisation who purchases or seeks services from Offshore Snow Shapes; it is also referred to as “you”.

PLACING ORDERS

All orders placed are subject to confirmation and acceptance by Offshore Snow Shapes. Offshore Snow Shapes may vary prices for received orders in the event of price changes. In the case of price increase, you may cancel the order by giving notice to Offshore Snow Shapes, which must be received within seven (7) days of the price increase notification. To minimise errors and improve efficiency, orders should be placed using our on-line ordering system whenever possible.

Other forms of ordering are accepted only if our on-line ordering system is malfunctioning or you have difficulty using it. Other ordering methods include E-mailing our sales, phoning or submitting order by fax. For some organisations where a purchase order is necessary, we still encourage the orders to be placed online and followed by a summarised purchase order. Quantity in stock does not take into account the orders already placed which are yet to be processed. It is possible that an order placed earlier will receive the allocation of the part in which the quantity for it showed as in stock at the time of your order. Inventory discrepancy can also affect the accuracy of the stock status displayed on our web site. Any attempt to cancel an order must be made as soon as possible. Cancellations attempted after the dispatching will result in the customer having to pay the shipping and handling charges on the package and the cost of shipping the package back. Cancellations may be communicated by email or Fax.

PAYMENT

For online orders, Stripe Payment Gateway using credit card is the only method of payment available. Electronic Funds Transfer in JPY is available, but only on request via email. The title of the goods supplied does not pass to the customer from Offshore Snow Shapes until the full amount is paid to Offshore Snow Shapes.

SHIPPING: SNOWBOARDS

Estimated shipping times worldwide:

1-2 weeks from date of full payment for stock models, subject to stock availability. We will notify you prior to purchase if out-of-stock and/or when restock is expected.

3 – 4 weeks from close of order window for custom orders.

We do not ship to PO Boxes for snowboards. We do not ship to third party addresses unless that address is known and can be verified by Offshore Snow Shapes. Customers are responsible for paying any freight charges incurred by refused shipment and unclaimed goods. Offshore Snow Shapes will make every effort to deliver on time. However, we shall not be held liable for delay or lost shipment.

Customers are responsible to have someone at the delivery address to accept the delivery. Any delivery requests must be made prior to the shipment of the order. Cost for re-delivery attempts will be passed to the customers if the delivery address is unattended at the time of delivery. When your order is shipped you will be sent an E-mail confirmation which will include an order number which can be used when enquiring about your order.

The cost of shipping snowboards is an additional cost, not included in the item price, and is paid by the customer.

SHIPPING: SOFT GOODS

Worldwide Estimated shipping times:

5-10 business days 

We deliver our clothing and accessories with Express post services in an effort to get your goods to you as quickly as possible. Express post service only applies to major metro areas and capital cities. The cost of shipping soft goods is an additional cost, not included in the item price, and is paid by the customer.

SHIPPING PRICE SUMMARY

RETURN, REPLACEMENT AND REFUND: SNOWBOARDS

There will be no credit given on order price difference, due to price drops. Please select carefully at the time when you place your order. 

There are no returns on custom order snowboards. 

If a custom snowboard is perceived to be damaged and/or defective upon delivery, we require that proof of damages or defects be provided within 7 days of the customer’s receipt of the snowboard(s), and the snowboard remains unused in the original condition it was received. In the instance of return for damage or defect, customers are expected to pay for return shipping costs. Once the goods are received, Offshore Snow Shapes will conduct inspections to ascertain whether or not the damages and defects were caused prior to the customers receipt of the board. If it is confirmed that the customer is not at fault, a replacement, a product of equal value or full refund will be issued, as well as compensation for the return shipping costs. 

Return for non-custom snowboards will only be accepted within 7 days of you receiving the goods. Shipping and handling cost are not refundable. This return for refund policy is applicable for change of mind, and lack of expertise for use of product. You must pay all cost associated with the return shipping.

If a non-custom snowboard is perceived to be damaged and/or defective upon delivery, we require that proof of damages or defects be provided within 7 days of the customer’s receipt of the snowboard(s), and the snowboard remains unused in the original condition it was received. In the instance of return for damage or defect, customers are expected to pay for return shipping costs. Once the goods are received, Offshore Snow Shapes will conduct inspections to ascertain whether or not the damages and defects were caused prior to the customers receipt of the board. If it is confirmed that the customer is not at fault, a replacement, a product of equal value or full refund will be issued, as well as compensation for the return shipping costs. 

Any incorrect, missing or damaged items received must be reported to Offshore Snow Shapes within 24 hours of you receiving the delivery. This can only be done by E-mail or phone. If item(s) received is not what was ordered please do not open the sealed package in which it was sent. Any attempt to use the incorrect item will be deemed to be acceptance by the customer of the item(s) as a satisfactory substitute for the one that was ordered and no further claim can be raised thereafter. Offshore Snow Shapes owns the title of any extra goods shipped with your order that have been dispatched in error.

In the case of product defect or malfunction after use please refer to our warranty policy.

RETURN, REPLACEMENT AND REFUND: SOFT GOODS

Offshore Snow Shapes do not issue refunds for Soft Goods. We may exchange or issue a credit note (valid for 6 months from issue date) for a change of mind purchase subject to several conditions: 

• Goods must be returned within 14 days of purchase with original tags and receipt.
• A refund does not apply to goods reduced for sales purposes however may be returned for either an exchange or credit note.
• Goods cannot have been worn, washed, used, soiled or damaged by the customer
• Shipping and handling costs are not refundable

A refund may be provided in the case of a damaged or faulty item.  Goods are inspected before packaging to ensure they are in excellent condition. Products are packaged carefully to ensure a minimal chance of damage during transit. If you receive a damaged or defective item please contact Offshore Snow Shapes within 14 days of purchase to be eligible for an exchange or a refund.

WARNING: SKIING AND SNOWBOARDING CAN BE A HAZARDOUS ACTIVITY. SNOWBOARDING EQUIPMENT EMPLOYS A NON-RELEASE BINDING SYSTEM, WHICH DOES NOT RELEASE EVEN UPON IMPACT. USE OF THIS PRODUCT MAY CAUSE SERIOUS INJURIES TO ANY AND ALL PARTS OF THE USER’S BODY. THE USER SHOULD RECEIVE INSTRUCTION FROM A QUALIFIED SNOWBOARDING INSTRUCTOR BEFORE USING THIS 

EQUIPMENT. THIS PRODUCT SHOULD BE USED BY MINORS ONLY WITH DIRECT SUPERVISION AND CONSENT OF PARENTS OR LEGAL GUARDIANS. NEITHER THE SELLER NOR THE MANUFACTURER SHALL BE LIABLE FOR ANY INJURY, LOSS, DAMAGES, DIRECT OR CONSEQUENTIAL, ARISING OUT OF THE USE OR INABILITY TO USE THIS PRODUCT.
